While talking to the company I bought the product from, I told them my tale of woe, and how this was our first holiday actually married and we had hopped to have something we could use every year. They chose to overnight to my office. So I should have it tomorrow.

I'm glad you got it taken care of.  Is the company making you pay for the new one, or are they going to send it to you for free?

Hey, as long as it's the truth, it's hardly a sob story as much as a galling one.  They WERE responsible for getting it to you intact, and if their delivery guy WAS so foolish as to (a) leave a fragile and/or valuable item on your doorstep or (b) hand it over to a stranger, they should rightly compensate you.

I forbid you from feeling guilty!  Light your menorah with your new Hubby as the holiday begins and shake all this off.  (But don't let your guard down with DQ!)

i have all packages delivered to my office b/c someone is always there to sign for it...and i don't have to worry that it will be stolen from my stoop or given to a horrible person like DQ.

If it was me I would also file a police report as just have a hard time believing that it was an accident. Obviously this can not be proved but her getting a visit from the police asking questions may well get it though her head that she should other peoples stuff alone (or at least your stuff)  and mind her own business. It would also start help if later on done the road she does something else stupid

I agree with the previous poster. You might want to let the police know that you want a "log entry" (I think that's what it's called) so they make a record of the incident but don't actively pursue it. Then the next time she pulls something like that (and who knows what the next thing will be? She accidentally scraped your car in the garage fifteen times while getting her garden rake out of the back seat of her car?) you'll have established a precedent.

As PPs suggested, they could dust it & see where DQ's finger prints are, to give a clue as to how it got broken, look at the pattern of the fragments, etc.

Where exactly does your property end?

Does setting foot in your little entrance area constitute trespassing? 

You could ask the police about getting a trespass warning.   That would mean if she enters it again, she could be arrested.

Well, they probably wouldn't dust it for prints, but you *can* tell a lot by how/where the breaks are.  I know when we had a problem w/ a neighbor kid who had a bb gun, the police took one look at the holes in our window and knew where the bb gun had been fired from (upstairs bedroom window of said neighbor kid's house).  So I think that a police report might not be a bad thing (even if the good company doesn't need it to get the insurance payout--but it might help them).

Oh my gosh!!!  I'm really sorry about your Menorah.     It's really a beautiful piece. 

As for DQ, she's evil and I'll bet a million cookies she dropped it on purpose.  JMHO.
