This was my first thought also.  I can't really believe that she dropped it accidentally.  "Accidentally on purpose" maybe.  If I am carrying something that is heavy and feel that I may drop it, I lower myself and the object to the nearest place to set it so I don't ruin it.

You know, things like this are usually packaged pretty well. I'd be surprised if a "normal" drop would break it.

I'm suspicious that Dresser Queen first opened the package out of sheer curiousity. Then, she may have dropped it out of spite.

I mean, really, I'd expect someone who'd broken something like that to either confess and apologize, or just look innocent and hope that you blamed UPS for breaking during transport. Saying that she'd dropped it "several times" almost looks like she's rubbing your nose in it.

I have friends who are Jewish and they have the coolest Menorah - it looks like part of an ancient wall with the pointed end jars hanging on it - they told me that you fill them with oil to burn them. 

I told them that the little jars were sized "just right" for my Nativity set. Not that I would combine faiths or hijack one thing for something else. Not knowingly anyway.

I have three words for you: Small Claims Court.


If the OP accepts the merchandise as is, then she owns it and could sue for the damages to it -- assuming she thinks she can prove the damages were done by the neighbor and not the shipping company or the even the seller.

But the merchandise didn't arrive intact and so the contract with the seller hasn't been completed.  Because of that, the damaged merchandise still belongs to the seller and the OP is owed either her money or a replacement.  That route seems a whole lot more sensible than Small Claims Court to me.

I just wanted to say that menorah is absolutely beautiful.  Makes me wish I used one just so I could have that one.  ;D
I am glad you have found a temporary replacement.  I have no suggestions that haven't already been made but I'm so sorry this happened to you.

if there's no sign of damage to the shipping box/materials, then the damage must have been done *after* DQ opened the package.  something like that piece should have been double-boxed and packed in huge amounts of packing peanuts or bubblewrap, if not with foam spacers!

the first thing the shipper (UPS, FedEx etc.) will ask to do is inspect the packaging, so do NOT discard any of it!  take digital pictures of the package and the broken menorah; you'll need that evidence when making a claim against either party (DQ or shipper).

what a beautiful piece.  i'm so sorry that it was destroyed :(

I think it is because I am not orthodox and I am worried they'll ask me questions I can't answer or judge me for being less observant. Probably an irrational thing.

While I don't agree with all of their beliefs, they do a wonderful job of helping people out with Jewish observance without being intimidating or horribly pushy.

I'm still thinking that she was stupid in thinking she could carry it, or possibly stupid in not realizing that it was glass, and therefore breakable. Accepting something for a neighbor is often a neighborly thing to do - and she may have been dithering around for a day or so, wondering how to tell Marina that she accidentally broke it.

I think there is a possibility that she was TRYING to be helpful and neighborly, and I'm concerned that reporting her to the police, or to small claims court, would be excessive. Back when she borrowed the cup of milk and thought that only poor and crazy people baked their own bread, I thought that she was trying to be friendly but had the social skills of a toddler. I'm still thinking toddler here, and if a toddler breaks something when trying to be helpful, you don't yell at them, or call the police - you thank them for trying, tell them what to do instead, and then ensure it doesn't happen again.

Marina, if you want to go wild on someone, go wild on the shipping company - they're the ones who really screwed up big time.

Marina, if you want to go wild on someone, go wild on the shipping company - they're the ones who really screwed up big time.

It's quite possible that she broke it accidentally but wouldn't the common reaction to be regret and an attempt to make amends? 

I'd go after the shipping company to pay for the replacement but I do know that leaving packages with neighbors is very common, and something that I am grateful for.  UPS in particular has inconvenient hours and is far away from my house so I'd much rather they leave it with my neighbor.

I think that it was this:

DQ: Well it is a little heavy so when I took it back to my place I accidentally dropped it a few times in the garage, so I opened it to see if it was OK...and it mostly is.

I find it a bit mind-boggling that someone can "accidentally" drop something "a few times" before you even leave the garage.

I agree - I didn't view it necessarily as maliciousness but she certainly displays a disdain for any property that isn't hers.  But, while it may have been just carelessness, she acted as if what she did was perfectly all right, required no apology, and then made out that she was the victim and terribly put-upon.

I am a clumsy sort on occasion and find myself having a very different reaction to my breaking something belonging to someone else, even if by accident.  As in, I would leave a note immediately that I received the box for my neighbor (upon receiving the box).  If I broke it in the meantime, I believe my reaction would have been along the lines of "I'm sorry - but I dropped the box and I think I broke it.  Please let me know if I did, and I will be happy to replace it.  Again, I'm really sorry - please let me know if it is indeed broken."

And I certainly wouldn't have opened it.
